The Law of 15 March 2023 (the „Law Blockchain III“) has been published in the Jounal officiel, and modifies three existing laws related to the financial sector in Luxembourg, namely, the amended Law of 5 April 1993, the amended Law of 5 August 2005, and the amended Law of 30 May 2018, and implements specific clauses that pertain to DLT, as defined in EU Regulation 2022/858, which establishes a pilot regime for market infrastructures based on DLT.
In Article 1 of the law, the words “including when such instruments are issued by means of distributed ledger technology” are added after the words “Section B of Annex II” in Article 1, point 19 of the amended law of 5 April 1993.
In Article 2, the words “including securities accounts held within or through secure electronic recording devices, including distributed electronic registers or databases” are inserted between the words “book entry” and “or tradition” in Article 1, point 8 of the amended law of 5 August 2005.
In Article 3, the introductory sentence of Article 1, point 26 of the amended law of 30 May 2018 is supplemented by the words „the following financial instruments, including when they are issued by means of the distributed ledger technology.” These changes aim to facilitate the implementation of the new EU regulation in Luxembourg.
Finally, Article 4 states that Articles 1 to 3 of the present law entered into force on 23 March 2023.
