The Haiti (Sanctions) (Overseas Territories) (Amendment) Order 2023 was recently published on legislation.gov.uk, the official website of the UK government for publicizing legal documents. The Order modifies a corresponding order of 2022, namely the Haiti (Sanctions) (Overseas Territories) Order 2022 (SI 2022/1347) which extends – with some minor modifications – the Haiti (Sanctions) Regulations 2022 (SI 2022/1281) and the Sanctions and Anti-Money Laundering Act 2018 to all British overseas territories except Bermuda and Gibraltar (which implement sanctions on their own).
Specifically, the now issued order modifies the 2022 order to reflect the new provisions of the latest UN Security Council resolution 2699 which „changed the existing targeted arms embargo on designated individuals to an embargo on the supply small arms, light weapons and ammunition to Haiti“ and resolution 2700 which extended existing sanction measures by one year and set out some other provisions as regards the beforementioned embargo.
Therefore, the new order replaces provisions relating to „Military goods and technology“ with provisions relating to the supply of small arms, light weapons, and ammunitions for use in Haiti and provides for penalties for violations relating to such supply. It also makes changes throughout to replace the term „Secretary of State“ with „Governor“ and permits the governor to issue licenses in relation to the new restrictions.
The order applies to all overseas territories listed in the enclosed schedule including Anguilla, British Antarctic Territory, British Indian Ocean Territory, Cayman Islands, Falkland Islands, Montserrat, Pitcairn, Henderson, Ducie and Oeno Islands, St Helena, Ascension and Tristan da Cunha, South Georgia and the South Sandwich Islands, The Sovereign Base Areas of Akrotiri and Dhekelia in the Island of Cyprus, Turks and Caicos Islands, and the Virgin Islands.
