The CNPD is actively involved in supporting the UIA in the organization of a seminar titled „Challenges for the law of obligations, artificial intelligence, fintech, data protection, and new legislation on digital services.“
Various prestigious institutions, including Bonn & Schmitt, the Bars of Strasbourg, the Institut de Droit Européen des Barreaux – I.D.E.B, the European Commission, the Court of Justice of the European Union, the Council of Europe, the University of Luxembourg, and the Luxembourg House of Financial Technology (LHoFT), are collaborating on this seminar.
One of the central issues addressed in the seminar is the lack of harmonization in certain areas of European law, particularly in contract law and the law of obligations, which leads to legislative competitiveness and challenges. Questions are raised about the current state of harmonization in Europe and the consequences of its absence. The seminar also explores potential solutions, such as the UNIDROIT principles and contractual clauses in international contracts.
The rapid advancement of digital technology, encompassing artificial intelligence, fintech, regtech, blockchain, cryptoassets, and robotics, necessitates legislative reforms. The seminar recognizes that existing contractual remedies are inadequate to address these developments and emphasizes the importance of legislative reforms. Ethical and human rights concerns related to technology are also highlighted, in line with Council of Europe initiatives.
The European Commission is actively engaged in an ambitious legislative reform known as the „EU Digital Package“ to regulate the digital economy and complement the GDPR. These regulations, adopting a sector-based approach, extend to mobility, health, work, and finance, reflecting a strategy to enhance the EU’s innovation attractiveness and competitiveness.
Furthermore, the seminar is open to both legal and non-legal professionals, offering sessions in both French and English with simultaneous translation. It is scheduled to take place from Wednesday, 11 October 2023, to Friday, 13 October 2023, at the Banque et Caisse d’épargne de l’État (BCEE) in Luxembourg City and the „Grande Salle“ of the Court of Justice of the European Union (CJEU).
