In accordance with Article 34 of MiFIR, ESMA has published a new version of its Public Register for the Trading Obligation for derivatives under MiFIR as of 4 September 2023.
Such obligation mandates that certain instruments are traded on EU trading venues unless there’s an equivalence decision for such trading in third-countries. The register outlines:
1. the classes of derivatives that are subject to the trading obligation;
2. the trading venues where such derivatives are traded;
3. third-countries deemed to be equivalent for purposes of the requirement; and
4. the dates from which the trading obligation took effect.
