The UK government has published an updated version of its Haiti sanctions guidance relating to sanction measures imposed on Haiti pursuant to the Haiti (Sanctions) Regulations 2022 (SI 2022/1281). With this guidance, the government aims to support firms in their efforts to comply with the instrument and related sanction provisions. The guidance thereby covers numerous issues, ranging from the purpose and scope of the regulations, to the prohibitions made by the regulations (trade restrictions, financial restrictions, and travel restrictions) and the implications of these for UK firms, to exemptions being granted from such restrictions.
This latest revised version contains updates to reflect the adoption of new Resolutions 2699 (2023) and 2700 (2023) by the United Nations Security Council which changed the existing targeted arms embargo on designated individuals to an embargo on the supply small arms, light weapons, and ammunition to Haiti, extended the travel ban and asset freeze measures imposed by previous resolutions, and called for extended measures to prevent illicit trafficking and diversion of arms.
The new guidance now discusses related trade restrictions (updates to sections 1.3 on trade sanctions), including new prohibitions on the export and delivery of small arms, light weapons, and ammunition to Haiti and the issuance of corresponding licenses under section 3.3.
