The Polish Financial Supervision Authority (KNF) has published a [statement]() to inform of a new document entitled „Mortgage brokers and their agents – formal and practical aspects of registration“ which is addressed at financial institutions and mortgage brokers and other mortgage credit intermediaries facilitating real estate loans to customers. Although the document has no legal value and does not replace reference to applicable laws and regulations, it provides useful guidance for mortgage credit intermediaries as regards the following, among others:
– the registration and authorization process including the conditions that must be met in order to be authorized, the application and authorization process themselves, and possible reasons for denial of authorization;
– any subsequent changes to the registration status;
– the entry into the register of credit intermediaries and as such, the purpose and structure of the register;
– the notifications that must be provided in case of passporting into other EU jurisdictions and notifications of EU mortgage brokers passporting into Poland; and
– the current application forms and how and when they shall be submitted.
The document also covers issues around the registration of agents with whom a broker may enter into agreements.
