Règlement CSSF N° 23-03 du 30 juin 2023

CSSF Regulation No 23-03 of 30 June 2023 transposes Guideline (EU) 2022/508 of 25 March 2022 amending Guideline (EU) 2017/697 of the European Central Bank on the exercise of options and discretions available in Union law by national competent authorities in relation to less significant institutions (ECB/2022/12), and amendings CSSF Regulation No 18-03 of 5 June 2018. The amendments encompass various sections:
Article 1, changes are introduced to include investment firms other than CRR investment firms under the provisions of paragraph (1) of Article 3 and paragraph (1) of Article 4 of Règlement CSSF N° 18-03.
Article 2 addresses the replacement of „établissements CRR“ with „établissements de crédit et entreprises d’investissement“ in paragraph 1 of Article 3 and paragraph 1 of Article 4 of the same regulation.
Article 3 modifies Article 5 of Règlement CSSF N° 18-03. It introduces exemptions from the application of certain provisions under specific conditions related to credit quality ratings and public support for export credits.
Article 4 inserts Articles 16 bis to 16 sexies into Section 2 of Part III of Règlement CSSF N° 18-03. These articles address various aspects related to liquidity coverage ratio, assets of level 2B, and financing stable net ratios for off-balance-sheet exposures.
Article 5 abolishes Articles 7, 11, 12, and 15 of Règlement CSSF N° 18-03.
Article 6 states that the current regulation comes into immediate effect.
