The U.S. Securities and Exchange Commission (SEC) has published new Form PF which will be valid through April 30, 2024 unless otherwise modified before. The form collects information aimed at monitoring systemic risk in the private fund industry, including hedge funds and privat equity funds.
Form PF is a regulatory filing requested by the SEC under the Investment Company Act of 1940. It must be filed in various intervals and upon significant changes as outlined in the instruction details. Among other things, the form collects general information on fund advisers (fund managers) of hedge funds and private equity funds such as identifying information and the type of funds being advised. It also collects information as to the value of assets under management, the composition of funds, creditors to a fund, investors in a fund, leverage used, counterparty credit risk exposure, and much more.
The SEC notes that the new form contains all outstanding amendments, which may, however, not yet be applicable. To sort out the compliance date, filers are recommended to review the latest ruling in this context (EventID 21097). A prior version of the form may be found here.
