The CSSF informs regarding the Request for a European Long-Term Investment Fund (ELTIF). This communication is in response to the amended Regulation (EU) 2015/760 on ELTIFs, specifically modified by Regulation (EU) 2023/606 on 15 March 2023, referred to as the „revised ELTIF Regulation.“
The Revised ELTIF Regulation introduces significant innovations compared to its predecessor and is available for detailed reference. It was officially published in the Official Journal of the European Union on 20 March 2023. The effective date of this regulation is 9 April 2023, and it will be applicable as of 10 January 2024.
The CSSF is taking relevant measures by updating the existing ELTIF application form. Interested parties can access the revised ELTIF application form, designed to streamline and expedite both new ELTIF authorization requests and subsequent requests for amendment.
The updated application form incorporates thematic sheets, each addressing specific aspects of the ELTIF application. Noteworthy is the inclusion of key questions within these thematic sheets, triggering additional questions based on the responses provided. Depending on whether an ELTIF is targeted at retail investors or not, certain sections within the „RETAIL PROFESSIONAL“ sheet may be greyed out, alleviating the need to provide information intended for retail-focused ELTIFs.
This strategic design enables the CSSF to clarify essential points early in the ELTIF authorization process. However, successful implementation of this approach necessitates careful and diligent completion of the ELTIF application form. To guide this process, a column titled „Footnotes“ is included in the form, providing assistance in accurately completing the application.
The updated ELTIF application form is mandatory for all new authorization requests initiated after the publication of this press release. Additionally, the form should be utilized for opt-in notifications and communication regarding substantial changes to an initial application.
