The Short Selling (Notification Threshold) Regulations 2023 were recently published in the Official Journal of the UK at legislation.gov.uk. The regulations raise the threshold of reportable net short positions that must be notified to the Financial Conduct Authority (FCA) as outlined in Article 5 of the Retained Short Selling Regulation (UK SSR) from 0.1% to 0.2% of an issuer’s total issued share capital. This measure is aimed at reducing reporting burdens of firms and is in line with current UK efforts to enhance growth and investment while maintaining stability and security in the UK financial market.
The regulations will come into force on February 5, 2024.
