On March 28, 2023, the Polish Financial Supervision Authority (KNF) released a press release to announce that the Chamber of Fund and Asset Management (IZFiA) published the „Standards on charging performance fees (success fee) in certain types of Closed-End Investment Funds“ which was previously consulted with the KNF. According to the KNF, the „Standards“ are in line with the Guidelines on performance fees in UCITS and certain types of AIF (ESMA34-39-992) of the European Securities and Markets Authority (ESMA) and with the expectations of the Authority as regards self-regulation of the industry. The new standards, so the KNF, aim to standardize the „charging and collection“ of performance fees of all funds marketed to retail customers.
The KNF expects all fund managers to adhere to the new standards to ensure comparability among investment funds and to enhance transparency in the assessment of performance fees.
