Following the publication of the Guidelines on cross-selling practices which became applicable from 3 January 2018, ESMA has published an updated version of the corresponding compliance table.
The table sets out which member states comply or intend to comply with the guidelines and – in latter case – by which date such compliance is expected. The table also provides links to the corresponding (confirmation) publications of the member states.
Of note, only if the respective competent authority of the member state adopts the measure in its administrative practice will the guidelines or Q&As have an effect on the application of supervisory law in the supervisory area of the authority. However, member states have their own interpretation of the obligation to implement ESMA guidelines and recommendations.
The new table indicates an update to the compliance status of Sweden from „intends to comply“ to “comply“.
