In view of the coming into force of new rules for U.S. money market funds (MMFs) and changes to the reporting requirements and forms of all funds on June 11, 2024 (EventID 22004), the Securities and Exchange Commission has issued revised Form PF which collects information aimed at monitoring systemic risk in the private fund industry, including hedge funds and private equity funds.
Form PF is a regulatory filing requested by the SEC under the Investment Company Act of 1940. It must be filed in various intervals and upon significant changes as outlined in the instruction details. Among other things, the form collects general information on fund advisers (fund managers) of hedge funds and private equity funds such as identifying information and the type of funds being advised. It also collects information as to the value of assets under management, the composition of funds, creditors to a fund, investors in a fund, leverage used, counterparty credit risk exposure, and much more.
The form specifies the information that must be provided by hedge and private equity funds and the corresponding filing deadlines, contains detailed filing instructions, and includes a set of frequently asked questions (FAQs) to assist in the filing and submission of the form.
