Commission Implementing Regulation (EU) 2023/2389 of 29 September 2023 determining that the information to be automatically exchanged pursuant to the agreement to be concluded between the competent authorities of Finland and the United Kingdom is equivalent to the information specified in certain provisions of Council Directive 2011/16/EU

New Commission Implementing Regulation (EU) 2023/2389 as regards an equivalence decision relating to the exchange of information between Finland and the United Kingdom under Council Directive 2011/16/EU dealing with administrative cooperation in taxation matters was published in the Official Journal of the EU.
Specifically, the implementing regulation specifies that the information to be exchanged between Finland and the UK under the „Multilateral Competent Authority Agreement“ on the automatic exchange of information on income derived through digital platforms (DPI-MCAA) is considered equivalent to corresponding provisions under the above noted Directive provided that
(1) the UK adopts the Platform Operators (Due Diligence and Reporting Requirements) Regulations 2022; and
(2) the DPI-MCAA is being concluded through the activation of the exchange relationship between Finland and the United Kingdom.
