Compliance Checklist for Application of Pooled Retirement Funds

The Securities and Futures Commission of Hong Kong (SFC) has issued a revised version of its Compliance Checklist for Application of Pooled Retirement Funds (PRF). The checklist MUST be submitted to the SFC alongside the prescribed documents or filing forms in the application process for being registered as a PRF. Among others, it contains or requires information on
(1) the fund (i.e. name, type of fund, management, fees, etc.);
(2) the fund management company;
(3) information to be disclosed in the marketing material (principal brochure) such as the investment objectives, fees, withdrawal procedures;
(4) provisions of the constitutive documents; and
(5) the confirmation forms to be submitted by various stakeholders to verify compliance with the authorization conditions and terms of the SFC.

The changes to the previous version are numerous and well indicated in the checklist itself. Please note that the new form must be used beginning December 22, 2023.
