The Bank of Italy and Consob have adopted ESMA’s Guidelines on standard forms, formats and templates to apply for permission to operate a DLT market infrastructure (ESMA70-460-213) into their supervisory practices.
The Bank of Italy and Consob are complying with guidelines issued by the ESMA 8 March 2023, regarding the standard forms, formats, and templates for applying for permission to operate a distributed ledger technology (DLT) market infrastructure. These guidelines aim to ensure the consistent application of the Pilot Regime and effective supervisory practices within the European System of Financial Supervisors (ESFS) and to guarantee the uniform application of articles related to DLT market infrastructure.
The guidelines apply to competent authorities and entities intending to submit an application for specific permission to operate a DLT market infrastructure and are applicable since 23 March 2023.
Applications for DLT MTF or DLT TSS of government bonds, or when the applicant simultaneously applies for permission under the TUF, should be submitted to Bank of Italy, and the relevant forms should be filled out in Italian and English and sent to PilotRegime@pec.bancaditalia.it. For further information Banca d’Italia can be contacted: info.PilotRegime@bancaditalia.it.
Additionally, entities interested in obtaining specific permission to operate a DLT market infrastructure must also submit an application under the MiFID II framework and/or the Central Securities Depositories Regulation (CSDR), as applicable.
Consob has provided instructions on matters within its sphere of competence on its website.
