The EU Commission has published a Corrigendum to Commission Delegated Regulation (EU) 2022/2580 in the Official Journal (OJ) of the EU. To recall, the Delegated Regulation defines the information that shall be submitted by financial institutions when applying for authorization as a credit institution in an EU member state, including information on the financial soundness of the institution, information of its operational structure or internal control mechanism, information of key shareholders, or information on the history of the institution, to name a few. It also specifies situations that may prevent the authorization of institutions with strong ties to legal or natural persons in third countries and provides a provision for having all the above noted information requirements waived, e.g. in case the information was previously provided already. The Corrigendum now sets out the application date of the Delegated Regulation which was accidentally specified as „XX.XX.XXXX“ in the original publication. Therefore, the Corrigendum modifies recital 14 and Article 13 relating to the „Entry into force and date of application“ to set the application date to July 18, 2023.
