[ESMA70-152-348 ] List of third-country CCPs recognised to offer services and activities in the Union

ESMA has published an updated list of third-country CCPs which are recognized to offer clearing services and perform activities in the EU in accordance with Article 25 of EMIR. The list also includes a table of classes of financial instruments by each counterparty which are covered by the CCP’s recognition.
Please note that despite the inclusion of the United Arab Emirates on AML blacklist (eventid=19706), ESA’s Joint Board of Appeal suspended ESMA’s decision to withdrawl the recognition decision of Dubai Commodities Clearing Corporation (DCCC) as a Tier 1 third-country CCP.

The recognition of Dubai Commodities Clearing Corporation (‘DCCC’) from the United Arab Emirates was withdrawn by decision of ESMA’s Board of Supervisors of 21 July 2023 due to the inclusion by the European Commission
of the United Arab Emirates to the table in point I of the Annex to the AML Delegated Regulation as being identified as a third-country having strategic deficiencies in its national anti-money laundering and counter
financing of terrorism regime that poses significant threats to the financial system of the Union. This decision of ESMA Board of Supervisors is currently suspended by the ESAs Board of Appeal.
