In order to ensure consistent and uniform application of the regulatory framework, Bank of Italy has initiated a public consultation regarding the extension of the European Banking Authority’s Guidelines on de-risking (EBA/GL/2023/04 and EBA/GL/2023/03) to supervised entities not directly targeted, please see also EVENTID#23188 and EVENTID#23213.
The consultation aims to extend the European Banking Authority’s Guidelines in two areas:
1. Policies and controls for effective management of anti-money laundering and counter-terrorism financing (ML/TF) risks when providing access to financial services EBA/GL/2023/04.
2. Changes to the Guidelines related to risk factors for the proper verification of non-profit organizations as clients (EBA/GL/2023/03), including supervised intermediaries who are not the primary recipients of these guidelines (referred to as „de-risking Guidelines“)
The objectives of this consultation stem from the European Banking Authority’s publication of guidelines on effective risk management for money laundering and terrorist financing in providing financial services on 31 March 2023. These guidelines have undergone a public consultation process from 6 December 2022 to 6 February 2023.
The Bank of Italy intends to conform to these guidelines, including extending them to supervised intermediaries who were not the primary recipients and were not part of the earlier EBA consultation.
This consultation is addressed to various entities, including those listed in Article 106 of the Italian Banking Act (TUB), trust companies, microcredit providers, Cassa Depositi e Prestiti, and Poste Italiane for their bancoposta activities.
Observations and comments can be submitted either through certified email (PEC) or in hard copy within 60 days from the receipt of the consultation document.
This consultation is conducted in accordance with the Bank of Italy’s provision from 9 July 2019.
After the public consultation, the Bank of Italy will analyze the comments received to determine whether to extend the guidelines to entities not originally intended to receive them.
