In view of the effective date of the Anti-Money Laundering and Counter-Terrorist Financing (Amendment) Ordinance 2022 on June 1, 2023, the Securities and Futures Commission of Hong Kong, SFC, has published a new General Notice (G.N. 3121/2023) in which it officially gazettes the new Guidelines for Virtual Asset Trading Platform Operators which are effective same day. The guidelines cover a wide array of topics, ranging from competence, fit and proper, and own fund requirements of platform operators, to requirements pertaining to the custody of client money or the management of cyber-security risks and conflicts of interest. The guidelines also describe ongoing reporting and notification obligations of operators and governance-related requirements such as internal audit and compliance obligations.
