A new consolidated version of European Central Bank Regulation (EC) No 2157/1999 in connection with the ECB’s powers to implement penalties on supervised institutions was published in the Official Journal (OJ) of the EU.
This updated version includes amendments made by Regulation (EU) 2023/1092 of the European Central Bank which included new provisions to require the publication of decisions by the ECB as regards the imposition of penalties, thereby providing an alternative means for publication (anonymized or delayed publication) in case the disclosure of certain details would endanger financial market stability, the undertaking concerned, or ongoing criminal investigations.
