The Economic and Financial Affairs Council (ECOFIN) has published a revised version of its document containing „information from the Presidency concerning the state of play of legislative proposals in the field of financial services“ of 8 December 2023. It distinguishes different colour-coded stages of each file.
The changes from the previous version are as follows:
1. The Council „adopted„ the final draft of the CMU package as regards the European Single Access Point (ESAP), as well as the review of Central Securities Depositaries Regulation (CSDR) on 27 November 2023. Therefore, the „trilogues„ are „in finalisation„;
2. The „trilogues„ regarding the“EMIR/ CCP review“ „are to start„;
3. The „interinstitutional negotiations„ on the „Listing Act Package“ concerning the proposal for a Regulation amending the Prospectus Regulation, Market Abuse Regulation, and the Markets in Financial Instruments Regulation and the proposal for a Directive amending the Markets in Financial Instruments Directive and repealing the Listing Directive are „still ongoing„; and
4. Due to the provisional agreement reached with the EP on 6 December 2023, the „trilogues„ on a proposed Directive on certain aspects of the minimum requirement for own funds and eligible liabilities, which is part of the package to amend the bank crisis management and deposit insurance (CMDI) framework, are „in finalisation„.
