Consob, has published its Regulatory Activity Plan for 2023, outlining the key areas of regulatory focus for the coming year.
The non-binding programming document contains both the annual plan of activities for the adoption of general regulatory acts („Piano delle attività regolamentari“) and the two-year plan of regulatory impact assessment activities („Piano delle VIR“).
The Regulatory Activities Plan for 2023 aims to provide information on the main issues that will be the subject of Consob’s regulatory activity, or on which Consob intends to conduct regulatory impact reviews. This is done in order to assess the suitability of its regulatory activity to achieve its aims, in relation to the overall onerousness of the regulatory framework. In this way, Consob seeks to ensure effective investor protection and proper functioning of financial markets by promoting transparency and integrity of financial transactions.
The Regulatory Activities Plan for 2023 includes a brief introduction on recent developments in the European and national regulatory framework in 2022 and their expected evolution in 2023. Also included is a schedule of the regulatory interventions planned for the coming year.
Among the various planned regulatory interventions are several works on the revision of Consob’s secondary legislation.
The main regulatory interventions planned for 2023 are:
– Adjustment of secondary legislation to European Crowdfunding Service Providers Regulation (ECSPR).
– Adjustment of secondary legislation to Securitisation Regulation (SECR).
– Implementation of the DLT Pilot Regulation (DLTR).
– Revision of the regulatory provisions on supervision of third country auditors and independence of auditors of public interest entities.
– Further actions for the proper use of the new competences provided to Consob by the Consumer Code for mystery shopping, in order to acquire probative elements useful for detecting violations.
The Consob also plans to provide changes to the Regolamento Mercati (Market Regulations) to align with the Decree-Law of May 17, 2022, n. 50, implementing Directive (EU) 2019/2177, modifying MiFID II with regards to data communication services, approved publication arrangement, authorized reporting mechanisms, consolidated tape provider, and implementing Regulation (EU) 2019/2175.
