The Bank of Italy has opened a public consultation on proposed modifications to the reporting requirements for guaranteed bank bonds.
The subject of the public consultation is the update of Circulars No. 286 and No. 154 of Banca d’Italia, which govern the reporting requirements for banks, financial intermediaries, payment institutions, electronic money institutions, securities brokerage firms, and collective investment schemes. The proposed updates pertain to the reporting of guaranteed bank bonds and are open for feedback and input from relevant stakeholders during the consultation period.
The changes mainly affect the 17th update of Circular No. 286, „Instructions for the Compilation of Prudential Reports for Supervised Entities,“ and the 77th update of Circular No. 154, „Supervisory Reporting of Credit and Financial Institutions – Reporting Schemes and Instructions for the Transmission of Information.“
The modifications aim to implement the new Title I-bis of Law No. 130 of 30 April 1999, introduced by Legislative Decree No. 190 of 5 November 2021. This legislative decree amended the rules on OBG, to implement Directive (EU) 2019/2162 on “covered bond issuance and public supervision, and Regulation (EU) 2019/2160 on exposures in the form of covered bonds.
The specific implementing provisions are found in Part Three, Chapter 3, of Circular No. 285/2013 of the Bank of Italy.
Circular No. 286 introduces a new reporting template comprising 14 items related to the quantitative requirements stipulated by the covered bonds regulations, “rules concerning the composition of the separate pool of assets (cover pool), and specific statistical information.
The amendments in this circular aim to facilitate Bank of Italy’s access to functional information required for supervisory purposes in light of the new regulations on guaranteed bank bonds.
Regarding Circular No. 154, the modifications introduce a new data collection survey to be transmitted in xml format.
The consultation period for these proposed changes will conclude on 19 September 2023.
