The Securities and Futures Commission of Hong Kong, SFC, has published a press statement to inform of a new Memorandum of Understanding (MoU) that was concluded between the SFC itself and the China Securities Regulatory Commission (CSRC). The agreement supplements the „Trial Administrative Measures of Overseas Securities Offering and Listing by Domestic Companies“ which will come into force at the end of March 2023.
The MoU „clarifies the arrangements and procedures for share issuance and listing, cross-boundary enforcement, supervision of intermediaries, and exchange of information between the CSRC and the SFC“, thereby enabling both regulators to discharge their supervisory functions, including the joint enforcement of cross-border (listing) violations in an effort to protect investors.
The MoU shall also contribute to the robust and orderly functioning of the financial markets in either jurisdiction.
