On 10 January 2023, the European Banking Authority (EBA) has published an updated version of the compliance table for its „Guidelines on internal governance under Directive (EU) 2019/2034“.
To recall, these IFD Guidelines (EBA/GL/2021/14) were published in November 2021 to take effect five months from then and shall support the implementation of a „clear organisational structure with well‐defined, transparent and consistent lines of responsibility“, according to Article 26(4) of Regulation (EU) No 2019/2034 (IFD) of the European Parliament and Council.
The present compliance table sets out which member states now comply or intend to comply with the guidelines and – in latter case – by which date such compliance is expected. The table also provides comments from member states who do not (intend to) comply as to the reasoning of the local regulators.
The revised version reveals that all jurisdictions except Germany and Poland comply or intend to comply with the ESMA guidelines. Italy was changed from „Intends to comply“ to „complies“ (Complies as of the date of notification, 28/12/2022).
