On 20 January 2023, the European Securities and Markets Authority (ESMA) published an updated version of the list containing questions received through its Q&A process. ESMA is working on developing a web-based tool to facilitate the submission of questions and the publication of questions received.
Compared to the previous version, the updated version contains one new question:
1. CSDR settlement discipline (Topic „Post Trading“) [section 9]:
Should cash penalties under CSDR apply in case of settlement fails linked to cross-CSD settlement between two CSDs where one CSD is an EEA CSD and the other one is a third-country CSD (TC-CSD)?
