This Instrument in connection with the extension of the temporary asset retention measures that applied / apply to firms involved in potential wrongful pension scheme member advice relating to the British Steel Pension Scheme was published on January 27, 2023 to be effective on January 31, 2023. It includes modifications to the Consumer Redress Schemes sourcebook (CONRED) to extend the asset disposal and asset use restrictions applicable to such firms to keep them from disposing any assets that may be needed to cover any redress claims by wrongfully advised scheme members.

This Instrument was published on January 27, 2023 to be effective immediately. It modifies the definition of „significant SYSC firm (Senior Management Arrangements, Systems and Controls) firm“ in same named Sourcebook to clarify that only firms that were previously included under the IFPRU (Investment Firm Prudential Requirements) Sourcebook definition of significant IFPRU firms and IFPRU investment firms will fall within the scope of the enhanced Senior Managers & Certification Regime (SM&CR).
