On 09 March 2023, the European Banking Authority (EBA) has published an updated version of the compliance table for its „Guidelines on a common assessment methodology for granting authorisation as a credit institution under Article 8(5) of Directive 2013/36/EU“.
To recall, these EBA Guidelines (EBA/GL/2021/12) were published in November 2021 to take effect five months from then and shall specify a common assessment methodology (‘CAM’) for granting authorisations in accordance with Directive 2013/36/EU (‘CRD’), in pursuance of the mandate conferred on the EBA by Article 8(5) of that Directive as amended by Directive (EU) 2019/878.
The present compliance table sets out which member states now comply or intend to comply with the guidelines and – in latter case – by which date such compliance is expected. The table also provides comments from member states who do not (intend to) comply as to the reasoning of the local regulators.
The revised version reveals that all jurisdictions except Czech Republic, Germany, Hungary and Finland comply or intend to comply with the ESMA guidelines.
