New Council Regulation (EU) 2023/1089 relating to sanction measures in view of actions that destabilize or threaten the sovereignty and independence of Ukraine was published in the Official Journal (OJ) of the EU. The regulation modifies Council Regulation (EU) No 269/2014 which sets out an entire sanctions framework in that matter. Specifically, the new regulation extends the grounds for sanctioning individuals and entities and having their assets frozen stipulated in Article 3 of the 2014 regulation to include
„leading businesspersons operating in Russia and their immediate family members, or other natural persons, benefitting from them, or businesspersons, legal persons, entities or bodies involved in economic sectors providing a substantial source of revenue to the Government of the Russian Federation, which is responsible for the annexation of Crimea and the destabilisation of Ukraine“.
In the previous provisions, family members were NOT affected by possible sanction measures.
