The United Nations (Sanctions — Haiti) Regulations 2023 have been published on Singapore Statutes Online, the official journal of Singapore. The regulations implement Resolution 2653 (2022) of the United Nations to lay out a sanctions framework regarding Haiti in view of continuing human rights abuses, violence, and a deteriorating political situation in the country.
The regulations, which do not apply to certain financial institutions and Variable Capital Companies (VCCs), include the following:
Prohibitions:
They specify that the following activities are prohibited:
– Dealing with funds owned or controlled by specified persons is prohibited.
– Making funds available to specified persons is prohibited.
– Supplying arms and related matériel to designated persons is prohibited.
– Using Singaporean ships or aircraft to supply arms and related matériel to designated persons is prohibited.
– Providing technical assistance, training, or armed mercenary personnel to designated persons is prohibited.
– A general prohibition against knowingly assisting or promoting any prohibited acts.
Duty to provide information:
The regulations require individuals or entities in Singapore or citizens of Singapore outside the country who possess or are aware of property belonging to designated persons or any parties relating to such designated persons, or have information about related transactions must inform the Commissioner of Police.
Exemptions:
The regulations permit exemptions from the above noted prohibitions, if approved by the Minister and if the exemption aligns with the intention of the United Nations Security Council.
Additionally, the regulations define what constitutes „offences“ under the regulations and provide for penalty provisions in case of violations. Also covered are the authority to inspect and seize cargo and the forfeiture of assets.
