The Bank of Italy has published a Communication, providing clarifications in the form of FAQs regarding the Anti-Money Laundering (AML) questionnaire.
The AML questionnaire is designed to fulfil the obligations set forth by Legislative Decree No. 231 of 21 November 2007, and its implementing provisions.
It requires the bank to collect up-to-date information from its customers to prevent and counter the use of the financial system for money laundering and terrorist financing purposes.
The FAQs on the AML questionnaire address the following areas:
– Questions related to exemptions (total or partial) from reporting
– Questions seeking indications for managing situations of particular operational complexity
– Questions from parties involved in extraordinary transactions
– Clarification on the counting of data concerning control measures
The answers provided in the Communication aim to facilitate participants in completing the AML questionnaire.
The FAQs provide additional operational clarifications beyond the instructions provided in the questionnaire.
However, the Bank of Italy does not provide definitive answers to clarification requests that require a broader assessment of AML regulatory interpretations.
Any points not clarified in the FAQs and instructions should be addressed by intermediaries based on their own assessments.
All clarification requests received will be examined to improve the structure of the questionnaire.
