The new Consumer Protection (Fair Trading) (Regulated Financial Products and Services) (Amendment) Regulations 2023 were published on Singapore Statutes Online, the official online platform for publicizing legal documents. The regulations modify the Consumer Protection (Fair Trading) (Regulated Financial Products and Services) Regulations 2009, a supplementary regulation under the Consumer Protection (Fair Trading) Act 2003, to make minor technical amendments only. Specifically, the 2023 regulations modify regulations 2 and 6 of the 2009 regulations to replace and update outdated legal references following the revisions of the titles of all acts in Singapore last year. The changes are as follows (as quoted):
In regulation 2(1)
(a) in the definition of “regulated financial products”, replace “(Cap. 48A)” with “1992”; and
(b) in the definition of “regulated financial services”, after “Commodity Trading Act”, insert “1992”.
In regulation 6
(a) replace “section 7(10)” with “section 7(11)”;
(b) replace “(Cap. 186)” with “1970”; and
(c) replace “approved by the Monetary Authority of Singapore under section 28A of the Monetary Authority of Singapore Act 1970 shall be” with “approved, or deemed to be approved, by the Monetary Authority of Singapore under section 31 of the Financial Services and Markets Act 2022 is”.
