EBA has initiated a public consultation on proposed changes to the draft ITS regarding the disclosure and reporting of the MREL and the TLAC. The amendments aim to incorporate recent and upcoming changes to the prudential framework and provide clarifications on reporting requirements.
The proposed amendments focus on three main areas:
– Information on the deduction of investments in eligible liabilities instruments of entities within the same resolution group (referred to as the ’daisy chain’ framework).
– Information on the prior permission regime for buying back eligible liabilities instruments issued by reporting entities and groups.
– Breakdown by insolvency ranking.
The consultation paper includes the draft ITS, accompanying documents such as the cost-benefit analysis, and an overview of questions for consultation. The consultation period for these amendments has been shortened until 18 August 2023 due to their limited impact. Stakeholders are encouraged to provide comments on the proposed amendments through the EBA’s consultation page. If adopted, the amendments are expected to apply starting from the reference date of June 2024.
A public hearing will be organised in the form of a webinar on 21 July 2023 from 10:00 to 11:00 CET. The EBA invites interested stakeholders to register using this link by 19 July at 16:00 CET.
