On December 15, 2023, the Financial Conduct Authority (FCA) has published a new FCA instrument, namely the Handbook Administration Instrument (No 68) 2023 (FCA 2023/47), to make minor, non-material changes to the FCA Handbook. Specifically, the instrument modifies the following manual and sourcebooks:
– Conduct of Business sourcebook (COBS)
– Insurance: Conduct of Business sourcebook (ICOBS)
– Mortgages and Home Finance: Conduct of Business sourcebook (MCOB)
– Banking: Conduct of Business sourcebook (BCOBS)
– Claims Management: Conduct of Business sourcebook (CMCOB)
– Funeral Plan: Conduct of Business sourcebook (FPCOB)
– Supervision manual (SUP)
– Consumer Credit sourcebook (CONC)
These amendments relate to, among others,
– the new financial promotion regime and the requirements thereunder;
– the notification requirements on code of conduct breaches to reference the new consumer duty;
– the notification requirements of the cessation of senior management functions also to reference the new consumer duty; and
– the reporting form to continuously report on appointed representatives to adjust the FCA’s email address.
