The Occupational Pension Schemes (Pension Protection Fund (Compensation) and Fraud Compensation Payments) (Amendment) Regulations 2023 as regards technical amendments to the Occupational Pension Schemes (Fraud Compensation Payments and Miscellaneous Amendments) Regulations 2005 (SI 2005/2184) and the Pension Protection Fund (Compensation) Regulations 2005 (SI 2005/670) was published on legislation.gov.uk, the official website for publicizing legal texts. The publication follows the recent conclusion of a corresponding consultation by the Department for Work and Pensions (please see EventID 20132 in this context).
Specifically, the regulations
(1) modify Regulation 7 of the Pension Protection Fund (Compensation) Regulations 2005 (SI 2005/670) to remove the requirement that surviving dependent children must be enrolled in educational classes within the past year to draw benefits from occupational pension schemes; and
(2) modify Regulation 8 of the Occupational Pension Schemes (Fraud Compensation Payments and Miscellaneous Amendments) Regulations 2005 (SI 2005/2184) to specify that the Pension Protection Fund (FFP) may make interim payments to cover scheme fees and costs in connection with the application of a pension scheme for compensation while the application is still pending.
